• Ordering products
After placing an order, you will receive an email from us acknowledging that we have safely received it. This does not mean that your order has been accepted. All orders are subject to acceptance by us, and we will send you a second email to confirm acceptance of your order. The contract between us (Contract) will only be made when we send you this email to confirm acceptance and dispatch. Only those products listed in the email as being dispatched will be included in the Contract.

• Availability
All items are subject to stock availability. We will inform you as soon as possible if all the products in your order are not available. If only some of the products in your order are available this will be explained in your acceptance and dispatch email. If you pay by credit or debit card we will not charge you for products which are not available unless they are to be ordered specially for you. If you pay using PayPal any payment made for products which are not available will be credited back to your PayPal account.

• Tracking your order
To enquire the status of your order you may contact us by email stating your name, address and date of purchase.

• Prices
Please be aware that the prices displayed on our site exclude delivery and callout charges which will be added to the total amount due, unless otherwise stated. Due to the large number of products on our site, it is always possible that some of the products listed on our site may be incorrectly priced, despite our best efforts. If we discover there is a pricing error, we will normally, at our discretion, either: (i) contact you and give you the option of reconfirming your order at the correct price or cancelling it; or (ii) reject your order and notify you of the rejection.

• Payment
We accept payment with the following credit or debit cards: Visa credit and debit cards, MasterCard credit and debit cards, Switch/Maestro debit cards, Visa Electron cards. We also accept payment by PayPal and Bank Transfer. Please note that if you wish to pay for your products using PayPal, and you do not already have an existing PayPal account, you will be required to set up a new account with PayPal directly. Presently, we do not accept cash and cheques as payment online. By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct. All transactions will be in pounds sterling. Non-UK credit card providers and banks will determine the exchange rates to be applied and may add an additional processing or administration charge in relation to such payments which non-UK card holders will be liable to pay. All orders will be charged at the time your order is submitted. If we reject or cancel your order for any reason this charge will be credited back.

• Delivery
Although we can deliver off mainland UK, delivery to these locations may take a little longer. When you have chosen the products you want to buy from us, the delivery address will default automatically to the billing address you have entered for your payment card. If you want us to deliver your order to a different address, you can choose this option as you go through the checkout process.

• Returns
You must return any products within 14 days of the date the products are delivered to you. All products must be returned with all original packaging, in Brand new condition and must be unused. If you fail to take reasonable care of the products before returning them to us, you may have to compensate us. The products are your responsibility until they reach us. If you are returning products from outside the UK or Republic of Ireland you will be responsible for the cost of returning the products to us by post. Please see the dispatch note enclosed with your products. If products are returned by post, you should obtain proof of postage from the postal service you use. We will refund the full price you paid for the products, using the same method you used to pay for them unless you choose to have a replacement. All returns and cancellations are subject to a 25% restocking fee.

• Cancellation Rights
You also have a right to cancel your order under the Distance Selling Regulations. If you wish to cancel you must tell us in writing or via the Contact Us page within 7 working days from the day after the date on which the products are delivered. You should keep evidence of having given your cancellation notice, such as a certificate of posting or save a copy of the email. You must return the products to us in accordance with these Terms and Conditions.

• Reasonable care
If you want to return or exchange your products, you must take reasonable care of them and they should be returned to us in their original condition, which means that:
You can open the packaging to look at the products.
You mustn’t fit the products to your vehicle or modify the parts in any way.
Ensure the part is correct for the vehicle you wish to assemble it on before fitting onto the vehicle.
Tags or stickers should not be removed from any item.
The original packaging should be retained and returned.
If you fail to take reasonable care of the products before returning them to us, you may have to compensate us. Our returns policy does not affect your statutory rights in respect of defective products.

• Risk and Title
The products will be at your risk from the time of delivery. Ownership of the products will only pass to you at the time of delivery or (if later) when we receive full payment of all sums due in respect of the products, including delivery charges.

• Your information
We will process personal information about you in accordance with our Privacy Policy. However, minimal personal information in stored in all circumstances.

• Product images
We make every effort to display as accurately as possible the images of the products that appear on our site. Although some images may not be a true representation of the products you will receive, the description and part number will be accurate. Part numbers and descriptions should be used in order to ensure a part will fit onto a vehicle, not the image presented at the time of purchase.

• Events outside our control
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control including Acts of God, fire, flood, severe weather, explosion, war, act of terrorism, industrial dispute, or acts of local or central Government or other competent authorities. We will not be held responsible for damage or faults directly or indirectly caused by the fitment of our products or the use of our services on any other part of a motor vehicle. This does not affect your statutory rights.

• Warranties and Claims
The length of warranty will be clearly stated on the sales invoice and is effective from the invoice date. It is your responsibility to ensure you receive the invoice at the time of purchase or installation as failure to provide the sales invoice will invalidate any warranty on any product or installation carried out by us. There is no limit to the number of repairs to your equipment which can be approved during the period of your warranty. All faults must be reported within 14 days for warranty repair work to be honoured. Repair work authorised by us will be carried out by our own technicians during our normal working hours only, which are typically Monday – Saturday, 9am to 5pm. If any fault to the motor vehicle is proven to have been caused by the installation of a product by us, the vehicle must be inspected by one of our authorised technicians in order to establish the root cause, All necessary repair work required to rectify the fault if caused by us must be carried out by us or a third party sub-contracted by us at our discretion, claims for repair work carried out by third party repairers will not be honoured.. Aftermarket products may void your motor vehicles manufacturers warranty; it is your responsibility to check with the warrantor prior to having any work carried out. We will not be liable for any costs incurred for any repair work carried out by a third party without prior written consent. You must operate your product in line with the manufacturer’s instructions and must not modify it or tamper with it. Your product must not have been removed, lost, stolen, misused, neglected, subject to malicious damage, or damage caused by fire, explosion, floods, lightning, storms, frost or other bad weather conditions, rust, corrosion or water. Your product must not be subject to a current recall either by us, the supplier or the manufacturer. Your equipment must be repaired at the same location as the initial installation unless we agree otherwise. You are liable for the cost of repairs if there is no fault found with the equipment or installation, or to the extent that it requires routine maintenance, cleaning, servicing, cosmetic repairs (e.g. damage to paintwork, dents or scratches). Payment will not be approved for costs arising from being unable to use your equipment or for any other loss or damage not included under your warranty which arises from the breakdown of your equipment, including any costs to remove or reinstate built-in or fitted equipment. Warranty does not cover replacement of consumer durables (e.g. batteries and fuses). Warranty applies to the original purchaser of our products or services or owner or the motor vehicle at the time of purchase or installation and is not transferable to subsequent owners. It is the motor vehicle owner’s responsibility to declare all modifications to their insurance company as failure to declare any modifications may void your insurance. It is your responsibility to inspect the vehicle after any work or installation has been carried out by us and immediately raise any concerns.

• Entire agreement
These terms and conditions and other notices elsewhere on our website contain the whole agreement between us and you relating to the supply of products. No other terms or conditions will form part of the Contract, unless agreed by us in writing and signed by an authorised Automotive Gadgets employee.

• Our right to vary these Terms and Conditions
We have the right to revise and amend these terms and conditions at any time.

• Law and Jurisdiction
This website, any content contained herein and any contract brought into being as a result of use of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English and no public filing requirements apply. These terms and conditions do not affect your legal statutory rights.

• Changes to our Terms and Conditions
Any changes we may make to our Terms and Conditions in the future will be posted on this page. These Terms and conditions were last updated on 25 July 2011.

• Liability
Our liability for Products which you may purchase through our site is subject to our Terms and conditions. We have taken every care in the preparation of the content of our site. However, we will not be responsible for any errors or omissions or for any technical problems you may experience with our site. If we are informed of any inaccuracies in the content on our site we will attempt to correct this as soon as we reasonably can. To the extent permitted by law, we exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our site, any website linked to it and any materials posted on it. This does not affect our liability for Products which you may purchase through our site.

• Acceptable use
Certain areas of our site may enable you to enter some content of your own. In such cases, the content must not:
Contain any material which is defamatory of any person, obscene, offensive, hateful or inflammatory.
Promote sexually explicit material, violence or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
Infringe any copyright, database right or trade mark of any other person.
Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety or be likely to harass, upset, embarrass alarm or annoy any other person.
Be used to impersonate any person, or to misrepresent your identity or affiliation with any person or give the impression that they emanate from us, if this is not the case.
Be used to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material.

• Site availability
If the need arises, we may suspend access to our site, or close it indefinitely. We will not be liable if for any reason our site is unavailable at any time or for any period.

• Viruses, hacking and other offences
You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs, keystroke loggers, spyware, adware or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
By breaching this provision, you may commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

• Linking to our site
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with applicable local, national or international law, regulation and good industry practice.

If any of these Terms and Conditions is held to be invalid, the remaining terms and conditions shall continue to be valid to the fullest extent permitted by law.

At Automotive Gadgets we aim to please our customers at all times. However, if you are unhappy about any aspect of our site or the service you receive from us and would like to make a complaint, please contact us within 14 days so that we may take relevant action.

Our website, any content contained herein and these Terms and Conditions are governed by and construed in accordance with English Law. Any dispute between us regarding this website or arising out of or in connection with these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of England and Wales.
